David Chua Lim Jr., the suspect in the road rage shooting which occurred in Cebu City, has just been freed.

David Lim, the nephew of alleged drug lord Peter Lim, spent a total of 2 nights in jail after the Cebu City Prosecutor’s Office set his bail at PHP 144,000 for his temporary release.

Lim was charged twice for the shooting and wounding of nurse Ephraim Nuñal following a traffic related altercation on March 19. A dashboard video camera captured by another motorist who witnessed the confrontation clearly shows Lim pulling out a gun and shooting the nurse.

Cebu City Mayor Tomas Osmeña personally led the manhunt in search of David Jr. 

Nuñal’s family, with help from the local police, filed frustrated murder charges against the heir of one of Cebu’s richest families. 

Assistant Prosecutor Ma. Theresa Casiño found probable cause to charge Lim with frustrated homicide and illegal possession of ammunition. Unfortunately, Casiño had to bump the case down to frustrated homicide due to the lack evidence which alleges that Lim had the intent to kill.

“A judicial examination of the evidence at hand would show that there is no sufficient basis to prove the existence of any of the circumstances stated therein (murder case),” said Casiño.

The resolution was approved by Cebu City Prosecutor Liceria Lofranco-Rabillas.

As seen on the viral Facebook video, Lim was seen shooting Nuñal in the right ankle and left thigh.

The Regional Trial Court set the bail at PHP 120,000 for the frustrated homicide and PHP 24,000 for the illegal possession of ammunition which is unlikely to put a dent in the millions of pesos the Lim family currently holds.

The Lim family was even capable of directly asking Presidential aide Secretary Christopher "Bong" Go to show clemency over David Jr’s actions. 

“We’re happy and thankful with the ruling. I’m optimistic that this case won’t prosper in court. But it’s not the word that doubts but the evidence behind the case,” said Orlando Salatandre Jr., Lim's lawyer.

This just goes to show the leniency one is afforded if they are wealthy enough.
